Candidate Rights & Disputes

Your rights

The federal Fair Credit Reporting Act (FCRA) gives you important rights when a consumer report is used for employment purposes. Depending on where you live or work, state or local law may provide additional rights.

  • An employer generally must give you a clear written disclosure and obtain your written permission before requesting an employment background report.
  • If an employer is considering a negative employment decision based in whole or in part on a report, the employer generally must first provide you with a copy of the report and a copy of A Summary of Your Rights Under the Fair Credit Reporting Act.
  • You may dispute information you believe is inaccurate or incomplete.
  • You may request a copy of your file, subject to identity verification and applicable law.
  • The company that prepared the report does not make the employer’s hiring or employment decision.

Request a copy of your report

To ask whether Background Answers has a report about you or to request a copy, contact our Consumer Assistance team using the information below. We will provide secure instructions and ask for information needed to verify your identity.

Please do not send your Social Security number, driver’s license, date of birth, banking information, or copies of identity documents through ordinary email or the website contact form.

Dispute information in a report

If you believe information in a Background Answers report is inaccurate or incomplete, contact us promptly. There is no charge to submit a dispute or for our investigation.

What to include

  1. Your full name and current contact information.
  2. The name of the employer or organization that requested the report, if known.
  3. A clear description of each item you believe is inaccurate or incomplete and why.
  4. Supporting documents, if available. We will explain how to send sensitive documents securely.

After receiving your dispute and verifying your identity, we will investigate the disputed information as required by applicable law. We may contact the source that supplied the information. When the investigation is complete, we will provide the results and, when appropriate, an updated copy of the report. Most investigations are completed within 30 days, although the law permits additional time in certain circumstances.

If an employer is reviewing your report

If an employer tells you it may make a negative decision because of information in your report, review the report carefully. Contact Background Answers right away if you believe anything is inaccurate or incomplete. You may also contact the employer directly if you want to provide context or supporting information. The employer—not Background Answers—makes the final employment decision.
